Terms & Conditions
1. General
These Terms & Conditions apply to all products and services supplied by Shout Marketing Services Pty Ltd (“Shout Marketing”, “we”, “our” or “us”). By placing an order with us, the customer (“you” or “your”) agrees to these Terms & Conditions in full.
These terms apply to all quotations, invoices, online orders, artwork approvals and production work undertaken by Shout Marketing.
2. Quotes & Pricing
All quotations are valid for 14 days unless otherwise stated.
Pricing is subject to change without notice due to supplier price increases, freight changes, stock availability or production cost fluctuations.
All prices are listed in Australian Dollars (AUD) and exclude GST unless otherwise stated.
Additional charges may apply for:

Artwork redraws or graphic design

Rush production
-
Freight and delivery
-
Colour matching
-
Special packaging
-
Setup fees
-
Additional print locations
3. Payment Terms
Full payment is required prior to production unless otherwise agreed in writing.
For approved account customers, payment terms are strictly as stated on the invoice.
Late payments may incur:

Interest charges
-
Debt recovery costs
-
Suspension of future work
-
Cancellation of outstanding orders
Ownership of goods remains with Shout Marketing until payment has been received in full.
4. Artwork Approval
Customers are responsible for carefully reviewing all artwork proofs prior to approval.
Approval confirms acceptance of:

Spelling
-
Colours
-
Sizing
-
Placement
-
Garment selection
-
Quantities
-
Design layout
Once artwork has been approved, Shout Marketing accepts no responsibility for errors identified after production has commenced.
Production will not begin until final artwork approval and payment have been received.
5. Colour Variations
Printed colours may vary slightly between:

Screen displays
-
Digital proofs
-
Print methods
-
Fabric types
-
Production batches
Exact Pantone matching cannot be guaranteed across all decoration methods and garment materials.
Minor variations in colour, sizing and placement are considered acceptable industry tolerances.
6. Production & Turnaround Times
Estimated production times are provided as a guide only and may vary due to:

Supplier stock availability
-
Freight delays
-
Artwork approval delays
-
Peak seasonal demand
-
Production scheduling
Shout Marketing is not liable for delays caused by third-party suppliers, freight companies or events beyond our control.
Urgent deadlines must be confirmed in writing prior to ordering.
7. Freight & Delivery
Freight charges are additional unless otherwise stated.
Risk transfers to the customer once goods leave our premises or are collected by the freight provider.
Customers must inspect deliveries immediately upon receipt and notify us of any issues within 5 business days.
Shout Marketing is not responsible for:

Freight delays
-
Lost parcels by third-party carriers
-
Incorrect delivery information supplied by the customer
8. Returns & Exchanges
Due to the customised nature of branded products, we do not offer refunds or exchanges for:

Change of mind
-
Incorrect size selection
-
Approved artwork errors
-
Colour preference changes
Returns may only be accepted where:
-
Goods are faulty
-
Decoration is materially defective
-
Products supplied differ substantially from the approved order
Claims must be submitted in writing within 5 business days of receiving goods.
No returns will be accepted without prior approval.
9. Customer Supplied Garments
Shout Marketing does not accept responsibility for customer-supplied garments or products damaged during decoration processes including printing, embroidery or heat application.
We reserve the right to refuse decoration on customer-supplied items.
10. Stock Availability
Product availability is subject to supplier stock levels at the time of ordering.
If selected products become unavailable, we may recommend comparable alternatives.
Shout Marketing is not responsible for supplier discontinuations or backorders.
11. Intellectual Property
Customers warrant they own or have permission to use all supplied artwork, logos and trademarks.
The customer indemnifies Shout Marketing against any claims relating to copyright, trademark or intellectual property infringement.
Shout Marketing reserves the right to refuse artwork deemed offensive, unlawful or inappropriate.
12. Promotional Images & Marketing
Unless otherwise agreed in writing, Shout Marketing may photograph completed products and use them for:

Social media
-
Website galleries
-
Advertising
-
Portfolio examples
-
Marketing material
Customers may request confidentiality in writing prior to production.
13. Limitation of Liability
To the maximum extent permitted by law, Shout Marketing shall not be liable for:

Indirect or consequential loss
-
Loss of profits
-
Business interruption
-
Delays outside our control
-
Third-party supplier issues
Our liability is limited to the replacement or reprint value of the affected goods.
14. Cancellations
Orders cancelled after artwork approval or production commencement may incur charges for:

Artwork preparation
-
Setup fees
-
Ordered stock
-
Production labour
-
Completed work
Custom products already produced cannot be cancelled or refunded.
15. Warranty & Australian Consumer Law
Nothing in these Terms & Conditions excludes rights available under the Australian Consumer Law.
Customers may be entitled to remedies for major failures under applicable consumer legislation.
16. Privacy
Customer information is used solely for the purpose of:

Processing orders

Communication
-
Freight and delivery
-
Marketing communications
We do not sell or share customer information with unrelated third parties.
17. Acceptance of Terms
By placing an order with Shout Marketing, the customer acknowledges they have read, understood and accepted these Terms & Conditions.
